FBI's Current Surveilliance Techniques Could Even Surpass Carnivore

Over at CNET News.com, Declan McCullagh says that the FBI may be using an invasive new surveillance technique that goes far beyond its abandoned Carnivore surveillance system. Apparently instead of just recording the online activity of a particular subject or suspect, agents are using “full-pipe” surveillance — sucking down all the online traffic that goes across a network’s router or switch — when they or an ISP can’t isolate a particular IP address or user to monitor. Only after more information can be divined that allows the agents to isolate a particular user’s traffic do they (supposedly) throw out all the other information they’ve collected. This means the FBI could be collecting the activity of all kinds of people who have done nothing to merit surveillance, and it’s a technique that was apparently too invasive for Carnivore. McCullagh also explores the legality of the technique, since it would seem to fall foul of the “minimization” demands of federal wiretap laws which require investigators to limit the amount of information they intercept that’s outside the scope of their investigation.

Carnivore = over-priced TCP/IP sniffer
Every then and now, a law enforcement agency comes up with trendy techniques to (legally) eavesdrop on a suspects’ traffic. Carnivore was nothing more than a over-priced sniffer that too, could have acted as a “full-pipe” surveillance tool, so there’s nothing ground breaking in respect to the surveillance technology. Perhaps what’s new are the minor modifications for detecting and isolating specific traffic like VoIP for instance, better metrics and reports creation, as well as newly introduced information-sharing concepts.
From another perspective, don’t fear the FBI, fear the NSA that’s (legally) full-pipping traffic from all the major telecoms to showcase data mining know how. A law enforcement agency also cannot just pop up at an ISP and say we have a suspect at your network but we don’t know which one it is, so we need to monitor everyone and see who’s doing bad things, not only because more people doing “bad things” will show up when nobody needed them to do so, but because of privacy violations. Full surveillance is however much more often abused than reported.
