    ...doesn't putting the burden of truth on TPB guys that they ARE NOT the owners actually imply that they are guilty of ownership until proven innocent?

    Or is this just semantics? Or should I actually become a lawyer?

    I'm sorry, is 24 cases of suicide within the organization not enough evidence to show that FT is hiring people who are prone to suicide?

    I mean, the proof doesn't get much more solid than that. Even psychiatric tests could not be more accurate.

    WAIT A MINUTE! Why are you all blaming France Telecom? The only thing they're guilty of is hiring people who are prone to suicide!

    We sit on this site daily and boast about how accountability/blame gets passed on to "the man" when people do dumb stuff (ie: kid kills family; blames Halo, rock music, and Google)

    I mean...the only HR checking that France Telecom should be doing is looking into a psych exam in their hiring process!

    Apple made iPod to work with iTunes. They're designed for each other. That's the way the entire Apple Ecosystem works.

    If they were to allow other devices to sync through iTunes -- here's what they would have to deal with:

    - Calls from non-apple consumers: "I bought bejeweled for my palm pre and it won't sync through iTunes" -- now people hate Apple because the games in the iTunes store aren't for Palm Pre people.

    - "My Zune says it's got 20GB free, but iTunes says it's full".

    Right now...when you call Apple about something iTunes - they know they can help you...because you're dealing with just Apple products.

    Actually, Mike...I'm going to play devil's advocate for a second. I hope you don't mind:

    I agree with you 100% on your views on piracy, suing to sustain failing business models and the like...

    ...but this isn't comparable to her point. The theory is the same, or the crime rather...copyright infringement. But that's as far as the analogy can go, logically.

    Lily copying your post would not cost you any viewers/subscribers/page views. It could, however, cost you new viewers/subscribers/page views since someone may have been like "oh, that's brilliant" and came here to read more from you...but beyond that, you're not losing any *money* (I transitioned from viewers/subscribers/page views to "money" as I assume that's one source of income for bloggers).

    However, filesharing does take money that the artist was previously making and turns that into a loss (fans who would've have paid before are now not paying for the music).

    Now, like I said, I with you on your views...I believe the music should be a business card for the artist, but the analogy here is not so linear...

    ...but I could be missing something. I'd never challenge you on anything business related (I'm just a geek who finds this stuff interesting to help pass the day) -- but the logic in this analogy seems a bit flawed.

    So, I'm hanging out with this girl. I'm 19 years old. We're watching Dogma at the matinee.

    During the movie, our body language is shifting. We're growing a bit closer. I reach my hand out, and she put her hand in mine.

    ...eventually, we kiss!

    Now, almost 10 years later...I'm still with the girl (getting married next summer).

    Kevin Smith will always hold a special place in my life...book or no book.

    I just sent this in to you guy...perhaps I should actually use the Crystal Ball before trying.

    This is absolutely ridiculous!! I don't know how many times that I've used the preview to listen to all the songs to make sure the one song I heard wasn't just a one-off track of the rest of the album.

    They should be thanking iTunes (and the like) for this feature.

    I mean, the kid that gets sued by Activision or whomever puts our Guitar Hero (I play games, but not ones that require a $100 worth of accessories to play) -- will never EVER EVER EVER become a legitimate customer. If Activision sued me to downloading a copy of their game...I wouldn't purchase anything with the word "Act" in -- due to PTSD.

    The Internet is built on anonymity. He'd need a court order to get the IP address of the current account holder, and as we've seen, IP addresses are not the end all/be all of identifying people online.

    PLUS! Creating false users accounts might be against the Twitter TOS but is not necessarily against the law. The court order would have to be issued once harm or law breaking has been established.

    Who knows though? Perhaps Devone Bess has a trademark filed for his name...but it's doubtful.

    But I'm not a lawyer. So, I could be entirely wrong here (it wouldn't be the first time).

    It's great that the artists are taking a stand, but it's also pointless.

    Most of them don't own the rights to their music anymore...so the point is moot. The RIAA/Music industry is NEVER going to say "well, the artists and the fans are pissed, let's stop". It's just NOT going to happen.

    Why Nevada? Because it has Las Vegas...? We have Northern VA -- which is nothing like the backwoods part of the rest of Virginia.

    Northern Virginia is awesome...and yes, I do smile in my Driver's License.
