I just can't see the justification for making your content less accessible since it seems ultimately to lead to it being less valuable. It makes absolutely no sense at all.
I guess they just fail to see the larger picture or maybe they even refuse to acknowledge it with hopes that it will go away somehow. Who knows? The simple fact of the matter is that media of all type is moving to digital format and away from physical format.
They are rapidly gettting left behind and they are either too ignorant to realize it or too stupid to acknowledge what is happening and adjust accordingly.
It sucks that he more than likely won't see much, if any, profits from the State of Texas for use of his image, but that's life and it's way unfair most of the time.
Hopefully, he can make something positive out of this and at least use the publicity in some way to make money in other ways as a photographer.
In reality, expecting to get paid everytime for usage of something that you create is a pretty unrealistic expectation that is next to impossible to attain.
It's simple really. You pay money for a service that you want. It's not like Google will do it for free because I am sure there are very real costs involved in doing that type of thing.
For a group so determined to make sure they are paid for everything, they sure don't seem to care about paying others as much. Not too surprising I guess when you consider who we are talking about.
My State is on a roll when it comes to embarrassing itself lately. This stupid Law seems much less important than say the MAJOR OIL SPILL or our state budget that is in turmoil.
The irony in all this to me is the fact that they just don't seem to understand that getting what they want is only going to make things worse for them. Much worse.
They truly don't seem to understand how bad their ideas are and how negatively it will affect their industry if they are actually implemented.
I may be too doom and gloom about this but I think that the fact that they are doing this is a sign that the process is done and they are about to implement it.

People create stuff all the time so what makes your creation so much more important? Anyone can create, it's how you market your creation and if people think it's worth buying that is the important part.

By all means, create away and invoke your right to publish in the manner you see fit. Or, based on your thinking, keep those precious creations to yourself and never publish it because you don't have any right to do it in the manner you see fit for some reason.
Although I find it sort of hard to get as outraged as I typically do about stuff like this I still want to point out that once again, it favors those who continuously whine about the need for more and more protections because they claim that their business is dying.
