The appearance of a specific creative work on TPB does not automatically render the potential profitability of said work null and void. (Regarding <i>The Dark Knight</i>: I paid to see that film three times in theaters, pirated it only a couple of weeks ahead of its DVD release via TPB, and ended up buying the DVD when it dropped.)<br />

How do you intend to prove the assertion that TPB, and pirates by extension, destroy the potential profitability of a creative work by merely existing?<br />

I tend to think of people using a government-granted monopoly (and a non-natural right) to circumvent the protections of the First Amendment as a far greater threat to the potential of artists to make money than The Pirate Bay will ever become.]]></content:encoded>

As Mike mentioned, the solution is of dubious legality and the far worse problem is that this is adding laws to close loopholes in other laws, which makes for more papers to read through for normal citizens to not understand, lawyers to abuse and for judges to carve out to meaninglessness.<br />

You need to keep the number of laws to a minimum regardless of economic and social policies. This is just adding more law-material without universally addressing the problem it is meant to fix.]]></content:encoded>
