Going over your data plan limit is entirely unrelated to whether you can use your data for your phone or your laptop. You can do one without the other.

I used it a lot on my laptop and never went over my cap. Never came close.

Aren't the carriers supposed to warn you when you are getting close to your limit anyway? I used my own means to tether like there was no tomorrow and never heard diddly squat from AT&T. I didn't exceed my plan limit on data. In fact, I never usually even come close -- including when tethering.

What's suspicious here is the fact that the phone was being quarantined until the cops had a chance to get a hold of it and erase evidence potentially incriminating them before any potential information leaked. That's unacceptable. Given the current circumstances it would unjustly violate rule utility principles not to convict these police officers with murder. If we as a society do not convict police officers with murder under these circumstances then we have made it advantageous to guilty police officers under these circumstances to get a hold of evidence and either destroy it or put it through some investigative circus (ie: the FBI forensic analysis circus) than for them to allow the person shooting the footage to publicly release copies. No, we as a society should, as a rule, discourage this sort of unacceptable behavior (of wrongfully confiscating potentially incriminating evidence) and punish these police officers presuming their guilt. Anything less is an outrageous injustice. I want murder convictions. I want future cops to know that, under these circumstances, you better not take any evidence potentially incriminating you unless you first have very good evidence supporting your innocence (video footage). Some forensic analysis circus doesn't count. This is an outrage. and your confusion shows the problem with everyone, not even the lawyers knowing what is covered by fair use and what is not.

The reason i believe this is fair use is the fact that they claim it took 6 months to create , while scroll is releasing software that does the same in an hour, how are you going to be able to compare when you cannot use the original.

And this is not about generating money from the content, the content is used as an example, which is allowed in fair use laws i believe or hope as nobody seems to know at the moment.

Eye-witness testimony is notoriously sketchy. The camera, when it captures the whole truth and isn't tampered with, is a lot better than human memories, which can forget, rationalize, etc, and people have been convicted of a crime based on witness testimony when other technologies (i.e. DNA, video tape, etc.) have ultimately overturned those convictions. The problem is that cameras are still really crappy and don't capture everything, and they tend to be directional and may not capture stuff happening on the periphery.

However, it is not being edged out entirely.
