RIM's Patent Appeal Denied, But Does It Matter?

For those of you keeping score at home, give a point to NTP, as a court rejected Research In Motion's bid for another appeal of the patent infringement ruling against it. Back in August, a three-judge panel upheld a jury verdict against RIM (though it reversed some findings in the decision), and RIM wanted the entire 12-judge court of appeals to rehear the case, which now goes back to the lower court where NTP will ask the judge to issue an injunction against BlackBerry sales in the US. RIM is saying it may try to appeal to the Supreme Court, which would drag the process out further in hopes of giving the Patent Office enough time to review and reject NTP's patents -- a strategy that seems to be more promising than winning in the courts.
