How To Get Spectrum Back From TV For More Useful Purposes

If you look at how our radio spectrum is allocated today, you discover that TV broadcasters have a huge chunk of spectrum (that chart doesn't directly display how much spectrum is actually included -- I remember seeing another chart, which I can't find now, that shows proportionally how much more spectrum broadcasters have). This was given to them -- entirely for free -- years ago, when spectrum wasn't used for much. These days, however, spectrum is precious for so many different things, and certainly much of it could be put to better use. Of course, the broadcasters aren't thrilled with giving up any of their windfall. For years, they dragged their feet, kicking and screaming, about switching from analog to digital broadcasting, which was needed to reclaim some spectrum. More recently, they've been fighting attempts to use "white space" spectrum -- which is spectrum that's unused, but close to used spectrum. The broadcasters insist there will be interference, while technologists insist the technology is good enough to block interference.

So, it's interesting that, just as we're hearing of the first tests of white space networks, the FCC is also talking to broadcasters about other ways to reclaim some spectrum and put it to use on something more useful and productive. Apparently, the plan on the table right now would be for broadcasters to give up the spectrum in return for a cut of the revenue the government would get in auctioning off the spectrum for wireless use. Of course, some may find it distasteful that public spectrum that was given to these companies for free can then get sold off with at least some of the money going to those who never bought or truly "owned" the spectrum in the first place. But, given that the FCC set things up in a way where it basically created a de facto ownership structure of the spectrum, it's difficult to see any reasonable way to get that spectrum back without paying for it.

In the link above, Adam Thierer suggests we just give the current holders property rights in the spectrum, and assume that they'll then sell it off to those who can do something more innovative with it (or change and do something more innovative themselves). I've long been a proponent of giving up the ridiculous idea of having the government decide how each slice of spectrum must be used. Why not let the companies who control the various slices of spectrum make use of it as they see fit? It seems more likely that we'd get more efficient uses of the spectrum. So, it's good to see more thinking about ways to put some of that spectrum to better use, but it would be nice if we allowed the market, rather than the government, to figure out how to best use it.

Verizon: US Broadband Is Really Competitive, If You Just Redefine The Market The Way We Want...

Almost all of the issues facing broadband in this country (our slow speeds and high prices relative to other countries, questions about "neutrality" and things like customers being forced into broadband tiers) are really symptoms of a lack of significant competition in many markets. Many customers really only have one or two options, neither of which they like (I'm in that camp myself). Yet, the broadband providers want to make everyone believe it's a really competitive market. That's why they've done everything possible to block the FCC from getting accurate data about actual broadband deployments and competition over the years. Their most recent plan has been about pitching the idea of an organization called "Connected Nation" to "map" broadband penetration. However, as has been discussed previously, Connected Nation seems more like a front for the big telcos to try to pretend there's significant competition... and an increasing number of doubts are being raised about Connected Nation's efforts -- even as it seems to remain a darling of DC politicians. However its "mapping" still won't look at house-by-house penetration and competition (by demand from the broadband providers) and the collected data will remain proprietary, rather than open.

Meanwhile, Verizon has put up a video claiming to explain why there's plenty of competition in broadband in the US, but it does so by pulling a neat little trick: rather than defining the market as DSL and cable providers, it dumps wireless providers into the mix... So when you add mobile data providers, yes, there are more players in the space, but that ignores the fact that (1) many of the mobile players and broadband players are actually connected (i.e., AT&T has both, as does Verizon) and (2) that the cellular wireless broadband providers are all greatly limited, and use terms of service that tend to forbid using the data account as a primary connection. In other words, they're not really part of the same market at all.

But, most importantly, the video fails to back up its thesis that the US is "one of the most successful broadband markets in the world." It says there's lots of competition, investment in new technologies and consumers are getting more as prices go down. That suggests there is, in fact, some competition in the market -- a point pretty much everyone agrees on. But it does nothing to compare the US to other markets around the world that have much more competition, much more investment and much greater consumer value per dollar spent. Just saying that because there's some competition, the US is one of the most successful in the world, doesn't back up the thesis at all. It's like saying that you won a baseball game because you fielded nine guys. You forgot about the actual game.

Are Cellphone Carriers Like Gas Stations?

It's a simple lesson from Kindergarten: Share. You probably don't think of oil companies as being particularly good at this - except perhaps in the sense of sharing oil price hikes at the pumps - but it turns out they have another hidden sharing skill that they'd rather you didn't see. They share gas and pipelines, run by pipleline firms called "common carriers". Although not widely known, there is very little difference between the gas you buy at competing fuel stations in the US. The gas is a commodity product based on quality specs, and the differences are mostly marketing.

The privately-owned national gas/oil distribution infrastructure is quite formidable (offering a massive legacy advantage over any future fuels). There are pipelines that cross the country, refineries, trucks, equipment, tanks, catchments, reserves - all to deliver fuel to a growing economy (yes, growing...over the long-term at least).

But it would be prohibitively expensive to build such an infrastructure for EACH of the gas station brands. So instead of separate pipelines snaking the country, one each for Chevron, Shell, Texaco, Philips, etc...they share. Tanker ships deliver a standard grade of oil to refineries where it is refined to standard grades of fuel. And while the refineries may be owned by a specific oil company, the fuel they produce is put in common pipes to transport across the nation. Thus, the premium gas that Shell puts in the pipe in California could be taken out by Texaco in Nevada. Since it is a commodity product, it doesn't matter whose batch of fuel is taken out of the pipe, it only matters how much. This pipe is quite "dumb", but the network is shared, and the commodity that is transported is a standard package - sound familiar to any telco people?

The Fair Trade Commission in the US has stopped gas companies from making false advertising claims, and if the companies are selling the same gas, they can't claim it to be better. Thus claims like "More powerful" get replaced with the metaphorical, nonsensical "Put a tiger in your tank!" Is shared infrastructure and a standards-based product killing the gas companies? No. How do they compete if the product they sell is EXACTLY the same as their competition? What's the value of brand?

The answer lies in a small trick. The FTC won't allow them to say their gas is better if it's the same. But if they inject some small amount of "additive" just before selling the gas to customers (This additive can be anything...even a secret formula of 11 herbs and spices) that's all it takes to claim a different product. And with a different product, the gas companies can claim to have a "cleaner running" product, or "burns better" or whatever angle they want to promote with their brand. It works. They have been sharing pipes for decades, so maybe their case is instructive for telcos.

There IS money to be saved from sharing a single infrastructure. Especially when the product is standards-based. GSM, EDGE, 3G, HSPA, LTE are all pretty standard. As are Metro Ethernet, IP backhaul, etc. So I believe the carriers are on to a good idea in reducing their CapEx by sharing common network elements. Even more so because of the frequent 2G-3G-4G-... upgrades needed to compete. They can easily continue to differentiate by offering special "additives" to their product.

And while the gas companies' additives are mostly snake oil. The telecom "additives" are quite important, and can truly differentiate a mobile subscription over the raw bits inside the dumb pipe: Customer service, retail presence, data services, location platforms, fixed/mobile integration, easy-to-read bills, the iPhone, fave-5, rollover minutes...these are all very important parts of the service mix, and are true differentiators about which customers care. The things that subscribers don't care about might as well be shared. Amazon.com and buy.com both ship with UPS - do you care that they share the delivery mechanism?

Sol Trujillo, outgoing CEO at Australian cellco Telstra, is making the opposite gamble, detailed in a speech at MWC. He thinks the differentiator is the network infrastructure, and is piling money into it to be the first carrier to offer high-speed LTE technology, contrasting his approach to the common-carrier approach of Telfonica and Vodafone. While LTE is great, thinking that the network is a differentiator is wrong, and shortsighted. No customer has ever cared about the technology or the infrastructure. And while Telstra invests in a brief technology lead with LTE, their higher costs of upgrades may eventually make them technology laggards compared to competitors that share.

I can see it now: "Cleaner burning Vodafone Wireless", or "AT&T. Put an Apple in your tank!"

Forget Just Locking Your Laptop's Wireless Modem, Now Operators Can Lock The Whole Machine

Mobile operators are increasingly looking to sell non-phone devices like laptops and netbooks with embedded or add-on wireless modems as a way to boost their subscriber figures and generate extra income. Typically, consumers buy the device at a discounted upfront cost, then get tied in to a long-term contract for monthly data service (2 years at $60 per month seems to be the norm in the US). If users quit paying their bills, in theory, they've gotten a laptop on the cheap, though of course they're still subject to the terms of the contract, and damage to their credit, and so on. But Ericsson, which makes a lot of the embedded modems, has announced some new technology it's calling a "kill pill" that allows mobile operators to remotely lock a laptop by sending a signal to it over their network. The company says it's ideal if a data user quits paying their bills, but it's not hard to imagine mobile operators coming up with more nefarious uses for the device -- like shutting a machine down if a user closes their account, even if they've fulfilled their contract.

No You Can't Sign Up For A Comcast Account And Resell It Throughout Your Building

While some progressive ISPs such as Speakeasy have allowed customers to "resell" their connections via WiFi, most broadband providers frown on the practice. They don't seem to mind the casual sharing between neighbors, but it's not too surprising to see Comcast sue a guy who tried to set up an entire wireless ISP business this way. It's almost creative... he subscribed to Comcast broadband at 35 different condos, and then advertised his own "connectivity" within each of those buildings. It's hard to believe his defense will work:

He said Comcast signals are often used to power wireless networks at places like Internet cafes and other businesses that charge users for access. "This is a practice that happens throughout any city," Clark said. "Unfortunately, we're one of the bigger guys in town - so, here we are."
I think he'll find that most businesses reselling access aren't using residential Comcast connections -- and even if they are, they're offering very short, temporary connections, rather than permanent service. While I actually think plans like the Speakeasy plan we discussed that allow subscribers to resell their connections is smart, that doesn't mean that this guy is going to get away with this "business."

Pre-Brief Of The Upcoming CTIA Conference

With the US mobile phone industry's leading conference kicking off in Las Vegas, I thought it might be fun to write a small "pre-brief" of the trends to expect from the show. This CTIA Show comes close on the heels of the huge, Europe-based Mobile World Congress, and I would have dropped a blog post from there...if my Netbook hadn't been stolen! Here's what to expect from the CTIA show:

App Stores: What was innovative about Apple's App Store? It is a single point of sales, it's trusted, compatible, it offers tested apps, and it gives a large (70%) revenue share to the application developer. Nothing new there, but damn, what a success. Once again, Apple succeeded by (not doing anything revolutionary, but) using a simple recipe that makes sense and motivates all stakeholders. Sadly, a similar 'imode' app store has been done by DoCoMo in Japan since 2000, but North American carrier imitations usually neglect being remotely 'open' and don't offer a large revenue share to developers. Turns out, this is fairly important if you want to stimulate a large, diverse offering of useful, high-quality applications. Anyway, all those companies that didn't copy imode are now copying Apple, so expect to see more news around Microsoft's store, RIM Blackberry's store, the Android store, and more. The trend is good, since it will get more money in developers' hands, and should help some phone owners find applications that make their devices more valuable.

Mobile Broadband/Embedded Broadband: There will be lots of talk and probably a bunch of announcements about mobile broadband access at the show. I am referring specifically to the use of cellular broadband modems in devices that are not phones, such as Netbooks, Laptops, cameras, readers, media players, etc. I am moderating a panel on this subject at the CTIA show, and I'm thrilled to be doing it, because it is such a major trend. The two driving forces to this trend are the 3G networks that are already in place, and carrier willingness to sell new kinds of service plans. Carriers have been somewhat stuck in a rut of thinking of mobile access as "one phone, one contract, $60/mo." But recently, their thinking has been changing, and the notion of wholesale businesses of selling connections to devices like Amazon's Kindle is gaining steam. Expect to see more news of daily connection plans for laptops (like Wi-Fi Hotspots), and wireless data bundled in the price of other consumer electronics. 

Femtocells: A femtocell is a small box that looks like a Wi-Fi router, and similarly plugs in at your home or small office. But instead or routing laptops to the Internet, a femtocell routes telephone calls from your mobile phone to your carrier. Put one of these in a home or office with poor cell reception, and instantly get four bars. That's good for you and the carrier, who gets to keep you as a customer. But what also benefits the carrier is that your phone's traffic is now carried over your broadband connection, saving their towers from having to allocate capacity to you. Sprint has it, T-Mobile uses a special variant, Verizon has recently launched it, and AT&T is piloting these devices. I expect femtocells to successfully creep into the marketplace, and we'll hear a fair bit about femtocells at the show, but also other new ways of delivering cellular service like Distributed Antenna Systems, Repeaters, and such.

Backhaul: Wireless data use is taking off. Driven by flat rates, popular and easy to use phones like iPhone, and supplemented by growing use of cellular modems to laptops and Netbooks, people are finally exchanging significant amounts of data traffic from cell towers. But these towers were initially put in place for highly compressed, narrowband voice traffic. As such, each tower was often connected by a meager T1 line. The connection that the towers have to the core network is called "backhaul," and yesterday's backhaul is woefully inadequate for tomorrow's data traffic loads. The short-term solution was to just add more T1s...but the costs of this rapidly become prohibitive. So the long-term solutions that will be discussed at length in Las Vegas are point-to-point microwave wireless relays, metro Ethernet, and fiber optic connections.

The Palm Pre: I'm not sure when the bandwagon is going to hit the trail for this device, but I'm saddling up right now. I've been negative on Palm for a while, but I saw the Pre at CES in January and was pleasantly surprised, but unfortunately didn't allocate much time to Palm. Subsequently, I spent some time with the Pre at MWC in February, and was very impressed. Of all the phones I have seen since the iPhone came out, this is the first one that I think may be better -- and I am very fond of the iPhone. I use a very powerful HTC Windows phone, and when I see the Pre in action, I find myself repeatedly saying "I wish my phone could do that." 'Synergy,' the Pre's ability to pull together your contacts, emails, calendars into one consolidated view, is a favorite element. But what really struck me was the User Interface, which is very visual, very touch, and very intuitive. I felt the same way I felt when I first saw the iPhone in action. The Pre is not an evolution of previous Palms. It is a new starting point, and like the iPhone, it seems devoid of classic silo thinking and lousy UI baggage. I can't predict whether the developer community will rally around the Pre, or whether Sprint and Palm will be successful in selling big volumes, but I want to call this one early: the Pre is a great smartphone.

More iPhone "killers": We've seen handset vendors offer so-called iPhone Killers at every turn since June 2007. I have found almost every such claim to be unfounded over the past 2 years. I have written that a touch screen and square icons do not an iPhone Killer make. But quarter-by-quarter, the competitors' claims get more and more credible. While HTC, Nokia, RIM, Samsung, and LG make incremental progress to matching the iconic device, I think Palm has the real bomb to drop, if they manage to get the Pre to market on time.

Android: The past year was almost devoid of Android handset announcements. Barcelona was strangely silent on that front. In fact, we haven't heard much about new Android handhelds since the T-Mo G1 was announced early in 2008! But there's enough rumors floating around to suspect a batch of Android announcements this week. Let's wait and see. 

Google Voice: Google recently announced their Google Voice service, and it has created quite a stir in the industry. The fixed carriers have long felt threatened by Google, although the search giant had yet to fire a shot across the mobile carriers' bow. So long as it stayed in search, email, web VoIP, advertising, and location services, Google was only a thorn in the cellcos' side. But with the addition of Google Voice (GV), Google is now going straight at the heart of the carrier's core service. GV is essentially a disintermediation play, where users will use just one phone number, provided by Google, and can intelligently route and manage their phone calls to desk, cellphone, voicemail, email, etc., by using a web dashboard interface. By using a Google phone number, users needn't even tell anyone their cellular or landline numbers -- the carriers become pipes for the Google Voice customer. Expect to see and hear some responses, which have already started from other newcomers like Skype, or classic solution vendors like AlcaLu.

Meet Huawei: If you are not familiar with this company yet, better learn how to pronounce the name. Huawei is the leading example of the next generation of telecom infrastructure providers out of China. They have been selling competitive equipment for years, but carriers in Western countries have been reluctant to adopt their products based on a perceived quality gap with leading vendors like Ericsson, Nortel, Motorola, and Alcatel-Lucent. But the winds are shifting. Tougher economic times, paired with some successful Huawei reference cases in Leap Wireless, Cox cable, and Canadian telcos, prove that Huawei can compete on quality and price. Huawei is growing its presence in the US, recently opening offices here in Silicon Valley. Could a major US carrier deal be in the making?

Mobile Operators Want Anything That Might Force Them To Compete... Taken Out Of Stimulus Bill

As debate over the massive economic stimulus bill continues, the trade group representing US mobile operators has weighed in, with its head, former-NFL-star-turned-congressman-turned-shill Steve Largent, saying that unless open-access rules are removed from the broadband section of the bill, carriers will be "hesitant to participate". News to Steve: the stimulus bill, and this section, aren't necessarily intended merely to further line the pockets of incumbent mobile operators. While he thinks open-access rules "will deter providers from taking advantage of the grant program," one would have to imagine that if incumbents sat on the sidelines, plenty of new entrants would be more than willing to open their businesses to the government support and use it to craft new mobile broadband networks that would provide some much-needed competition in the space. Furthermore, such open access requirements didn't stop Verizon from shelling out several billion dollars for spectrum licenses last year. It seems that the CTIA loves it some stimulus -- as long as it doesn't stimulate any potential competition for its members.

Kevin Martin Agrees To Drop Filters From Free Wireless Web

M2Z's big plan to provide wireless internet to the entire country, if the FCC would just hand over free spectrum, never made all that much sense to us. Yes, the country could have a much better broadband infrastructure, and there are some interesting possibilities in the wireless space, but simply handing over a bunch of spectrum to a single startup company with a promise to provide free wireless to most of the country just seems like a boondoggle. There's little evidence that the plan would work or that it is even necessary. So, it seemed good that the plan went down in flames earlier this month -- though, most of the criticism was focused on the pointless requirement for anti-smut filters on the free connectivity.

However, Kevin Martin is making some news today by telling everyone who will listen that he's willing to drop the filters part if he can get the rest approved. This is a little surprising from Martin, as he's been a pretty big anti-smut crusader in his role at the FCC, but perhaps he's looking to leave a legacy beyond "AT&T lackey" now that he's about to leave the FCC. It still doesn't appear that he has the support to push this through, but that could change. Still, it would be good if someone (anyone?) could explain why it makes sense to just give a single company this spectrum without any clear reason why it should get the spectrum or proof that it can provide what it wants to provide in a reasonable manner? We've seen tons of promises about broadband wireless over the years from upstarts and very few have gone anywhere. Before just handing over valuable spectrum to one provider, why not see if (a) it's actually necessary and (b) if the company in question can actually provide what it claims it will provide.

North Korea To Get 3G Network... Despite Mobile Phone Ban

You may recall back in 2004 that North Korea banned all mobile phones following a freakout after news of a train accident started to spread. Phones had started to become quite popular, especially with local businessmen (and even more so near the border where they would trade with the Chinese). However, for four years, mobile phones have been pretty much entirely banned. This was in striking contrast, of course, to South Korea, which has been on the leading edge of mobile phone technologies for a decade.

However, it looks like North Korea may have finally realized that mobile phones are somewhat useful. It's granted a license to an Egyptian company, Orascom Telecom, to develop a mobile network. Of course, Orascom may find it difficult to really attract that many users, as the service will only be authorized for purchase by top government and military officials. Can't let the riffraff chat with each other, of course. And, of course, there's always the chance that, once built, the North Korean government will just claim the network as its own. While perhaps this is a step towards more communication in North Korea, so far it looks like the plan is to only use it for the government.

Cable Companies Figuring Out Their Wireless Strategies: Add Value To The Core Offering

While the cable companies have long had trouble coming up with a good wireless strategy (including numerous false starts) it looks like some may be figuring this out, in setting up business models where the wireless acts as a free value-add that keeps customers tied to their core, profitable businesses. For example, the article discusses Cablevision:

As such, Moffett likes Cablevision's WiFi strategy because it serves as a value-added service for its customers, and it's cheap to roll out. Moreover, Cablevision is pitted against Verizon in New York, and Verizon can't match the free WiFi offering.

"Their model is to pay for the WiFi network by, well, giving it away," Moffett said. "The $300 million of capital spending required to build it, and the modest operating costs to run it, can be paid for with just a small uplift in market share--either gained or retained--in their wired broadband service. At an ARPU of $35 per month and 80 percent contribution margins for wired broadband, it would take only 160,000 incremental subscribers--just 3.6 percent share of their cable footprint--to earn a 10 percent return on investment."
This is interesting for a few reasons. First, it shows yet another case where a company realizes that even if the initial costs are huge, if the marginal costs are low, and the "free" product better ties customers to a scarce product, it can make sense to give the other product away. So, yes, once again, there can be a good ROI on a "free" product -- even one that costs $300 million to roll out.

Of course, what may be even more noteworthy is the comment about how "Verizon can't match the free WiFi offering." That's quite amusing, because, five years ago, Verizon started implementing a plan to... offer free WiFi to Verizon DSL customers in NY. And, the plan wasn't even that expensive, because it made use of all the Verizon telephone booths that were already installed. In fact, the plan was seen as a pretty big success, responsible for reducing customer churn in such a way that more than paid for the service (exactly as the analyst is predicting will happen with Cablevision's offering). Yet, the bigwigs at Verizon still decided to kill the program, because, for reasons that still escape us, some execs were worried that it would compete with Verizon Wireless' EV-DO cellular wireless offering. Wonder if they regret that decision now?

Name the standard, and we can probably find someone claiming patents on it. There are still ongoing patent battles surrounding both WiFi and WiMax. The latest is apparently surrounding LTE, the choice of many mobile providers for their 4G next generation wireless. A company named ADC is claiming that LTE violates its patents and is now asking for royalties. As per usual, the company claiming patents over the technology just so happens to show up after a bunch of folks have committed to the technology. Funny how that works.

Cox To Enter The Mobile Phone Business... For Real

It's no secret that the various cable companies have been interested in offering some sort of mobile phone service. A few years ago, the biggest cable companies (Comcast, Time Warner Cable and Cox) teamed up with Sprint to offer mobile phone service under their own brands, building on Sprint's experience in allowing others to offer their own branded mobile phone service (known in the business as being a mobile virtual network operator -- or MVNO). Of course, since then, a ton of MVNO efforts have failed (remember ESPN's own mobile phone service?) and the cable companies never actually moved forward with offering service on Sprint's network. There was some thought that the cable companies were still interested in something in the mobile space, and Comcast and Time Warner are a part of Sprint's WiMax offering, but clearly Cox had decided to go its own way by that point.

Even so, it's quite surprising to find out that Cox is entering the mobile phone business for real -- as in building its own network. The company has apparently been acquiring spectrum to serve its market, and negotiating with handset providers. The article is a little unclear, but it sounds like there may still be a roaming agreement with Sprint, since the article claims the phones will work on both Cox's network and Sprint's -- suggesting Cox is working on an EVDO network. However, the company also claims that it's looking at using LTE as its "4G" technology. LTE is the technology chosen by pretty much everyone else in the US but Sprint, which is betting on WiMax.

Cox claims that its mobile service will be highly integrated with the other aspects of its business, including letting people watch TV on their handsets, control their DVRs from the handsets and automatically synchronize phone address books with home computer address books. It's good to see them thinking about real integration between services, because that's still pretty rare, but those services are all going to need to work pretty well together to make it really convincing for most people. Either way, you could see this as the epilogue to the death of MVNOs. While we've already seen that most MVNO plans went nowhere, it's quite a statement when a company is now choosing to build its own damn network rather than just piggybacking on someone else's.

WiMax Finally Available... In 2008... In Baltimore

For years and years we used to make fun of the press and analysts for either saying that WiMax existed when it did not or for predicting huge uptake before the tech was even ready. Plenty of companies offered wireless broadband, but it was not WiMax, no matter what they (or the press) called it. Back in 2003, we even made a pretty clear prediction: WiMax would not be ready for prime time until 2008, going against plenty of analysts who insisted it would be the big thing in 2004. And 2005. And 2006. And 2007. So, it's nice to see Sprint squeeze in the launch of its WiMax Xohm service before the end of 2008, and make our prediction accurate. Of course, those analysts who predicted huge WiMax success stories in 2004 have moved on and have already declared WiMax dead, and now LTE is the huge success story to watch out for. Let's wait and see on that one as well. There's just something about wireless technologies that make the press and analysts assume that what is being talked about at the tech level will take the world by storm immediately. These things take time.

AT&T Says It Will Cut Off P2P Wireless Users; But What About Pandora Users?

While those who like to claim that the US broadband market is more competitive than it really is like to point to the rise of 3G wireless networks as proof, they almost always ignore the fact that those 3G networks come with insanely restrictive terms of service, that allow the providers to cut users off for almost any activity outside of email or web browsing. For example, using such a service for video and music has been prohibited in some terms of service. Sprint was the most open with their 3G wireless until recently.

Now AT&T is admitting that if it discovers users of its wireless broadband 3G service are making use of P2P apps, it will cut them off completely, and claims that it makes this clear in the terms of service. It hasn't happened yet, but this bit of data will supposedly be used by a dissenting FCC commissioner this week to show that Comcast's traffic shaping is pretty tame compared to other "rules" out there on network usage (ignoring the very different nature of the networks in question, of course).

This raises a number of questions: If AT&T's biggest concern about P2P file sharing apps is clogging its 3G wireless network, why does it allow streaming apps to run on the iPhone? For example, one of the most popular apps on the iPhone is Pandora, whose customized streaming radio offering is super popular (and appears to work quite well). So is AT&T going to cut off users of one of the most popular apps on the iPhone? And how will AT&T respond when someone (inevitably, if they haven't already done so) develops an iPhone app for P2P file sharing as well? This really just seems like AT&T slipping an excuse into the terms of service to cut off anyone they don't like -- but in the long run it may backfire as people get pissed off at AT&T for limiting what new devices like the iPhone can do.

Bad Ideas: Stealing Products That Can Be Tracked Wirelessly

Slashdot points us to the amusing story of technology "solving" a theft of an irrigation controller on a farm, thanks to a wireless connection. The irrigation controller was stolen, which was first noticed when it sent an error message to the guy who runs them. A few weeks later, though, he was surprised to get a signal from the controller, and he was able to communicate with the device and get the company that supplied the wireless connection to triangulate and reveal the general location of the unit (the guy had the maker of the controller, who obviously contracts with the wireless provider, request this info to make sure the request was legit). From that, the guy used Google Earth to figure out where the controller must be -- and went to the local police. After investigating the person whose property it ended up on, the controller went missing again... only to turn back up in its original location a few weeks later.

While it's a neat story of technology thwarting a theft, there are a few questions raised by the story. To be honest, the full writeup so pumps up this particular brand of irrigation controller system, that it almost sounds like an apocryphal story made up to hype up how much better this controller is than competitors (look, it's theft proof!). Also, despite the "happy ending" -- the actual thieves were not apprehended, and future thieves will simply learn to disable the wireless communications ability. In the meantime, though, it's a reminder that technology is making the job of the ordinary thief somewhat more difficult these days.

Overly Optimistic: Analysts Predict Cellular Broadband To Surpass Copper Broadband By 2010

There's just something about new wireless technologies that seems to make analysts over-estimate their impact. I still remember when people were talking about how GPRS was going to be a real DSL replacement. GPRS, of course, was an incredibly unreliable and ridiculously slow update on GSM wireless technology. Yet, before it was used, there were stories predicting how it would be a wireless revolution. And then people started using it. And pretty much the same thing has happened with each advance in cellular technology. I remember people saying that EDGE, EV-DO, and HSDPA (all network upgrades) were going to be good enough to replace DSL or cable modems. Yet, even though EV-DO and HSDPA get decent speeds (still much slower than your average DSL or cable), the real problem is how these networks simply don't have the capacity to be a real home broadband replacement. That's why all of the contracts have ridiculous limits, suggesting you can't do very much with them, and often placing exceptionally low usage caps on the services.

Of course, don't tell that to the analysts, who can't resist making the same exact prediction about cellular broadband replacing home broadband. The latest such report is focused on the UK, and says that cellular based broadband for computers will surpass DSL or cable as the primary connection for users by 2010. That's not very far in the future. Now, certainly, mobile technology has improved greatly over the years, and there's still plenty more to come. However, the only really consistency in the mobile world is that many analysts over-estimate both the speed with which these new networks are adopted and the quality of these mobile networks. It would certainly be great, if true, but consider me skeptical.

Patent Battles Continue Over Wireless Email

While RIM is often portrayed as a victim for having to pay out $612.5 million in the patent infringement lawsuit filed by patent holding firm NTP, what gets less attention is that part of what kicked off NTP's lawsuit was the fact that RIM itself was going around suing pretty much everyone for patent infringement itself. And, of course, that kicked off all sorts of copycats, such as Visto -- a company that clearly learned the art of wielding patents against more successful companies from NTP. Visto and RIM ended up in quite the patent battle, with Visto even claiming that RIM should be shut down.

But, in the end, rather than the other way around, it turned out that it was Visto that was found to be infringing on RIM's patents. At this point, though, hasn't anyone realized how ridiculous it is that there are so many companies claiming to hold patents on some aspect of "wireless email" that no one can enter the space without having a bunch of infringement lawsuits waiting for them? This is not what the patent system was designed for.

Intel, Google, Cable Co's Give US WiMax A New Lease On Life (In The Form Of $3.2 Billion)

A bunch of the worst kept secrets in the wireless broadband world have finally come together. No one ever really believed that Sprint and Clearwire would fully break off their WiMax agreement. It simply made too much sense for them to get back together. At the same time, everyone also knew that Comcast and Time Warner were talking to Sprint to help fund WiMax in order to get a wireless pipe with which to compete with the telcos. And... oh yeah, given how much money Intel had pumped into WiMax to make everyone think it just had to be the next generation wireless system, there was no way it was going to let Sprint and Clearwire's WiMax plans collapse. Finally, toss in the fact that Google was known to be interested in Sprint's WiMax plans, and it's not hard to figure out what is actually happening...

Yes, indeed, Intel, Google, Comcast and Time Warner are teaming up to pump $3.2 billion into a joint venture that would merge Sprint and Clearwire's WiMax operations under the Clearwire brand name. This is certainly no surprise given all the earlier stories, but given how many problems have surrounded WiMax as well as earlier attempts for the cable companies to offer wireless services, don't expect this new venture to go smoothly right from the beginning. That doesn't mean it's not the right thing to do. Most of the companies involved didn't really have much of a choice but to do this. Of course, in all this mess, Sprint and Clearwire squandered a portion of the lead they held over AT&T and Verizon. While it will still take a while for AT&T and Verizon to get LTE plans into motion, all this futzing by Sprint and Clearwire took away some of the huge lead it should have had.

Dear T-Mobile, The Point Of 3G Is For Data Speeds

T-Mobile was the one national US mobile operator who really didn't have much of a strategy when it came to upgrading its network. While Sprint, Verizon and AT&T all were working on 3G options, T-Mobile kind of sat around twiddling its thumbs. Then it finally realized that it was way behind and made an effort to catch up. Years after everyone else got around to launching stuff (and as they're all now setting plans for their 4G options), T-Mobile is finally launching its 3G wireless service. But in a move that makes absolutely no sense, it's only for voice -- not for data. If it's only for voice... there's no reason to move to 3G. The very purpose of the 3G mobile network was to enable higher bandwidth for data. This is like building an entire highway next to a perfectly good bike trail... and then saying the highway is only for bicycles. Why bother? Update: Well, phew. Turns out the original story was simply not true. T-Mobile launched with voice and data...

Kevin Martin's Latest Gift To Telcos: Dismissing Skype Petition

A little over a year ago, Skype filed a petition with the FCC asking to extend the Carterfone decision to mobile networks. The Carterfone ruling was what allowed people the opportunity to connect non-AT&T telephones to the phone network, and kicked off an awful lot of innovation in the telephone arena (getting everyone past the black rotary phones). The Skype petition was a bit misguided, because the situation in the mobile world was quite different than the AT&T telephone monopoly of the 1960s. In fact, there is a lot more competition and openness in the mobile world -- and that competition has pushed many of the players to continue to open up at a greater rate, knowing they need to in order to compete.

So, it probably doesn't come as much surprise to find out that telco buddy Kevin Martin is dismissing the Skype petition outright. He announced this at the CTIA conference, where it was greeted by applause -- suggesting that it was mostly employees from mobile operators in the room. Martin pointed out that there was a lot of competition in the mobile space and also noted Verizon Wireless' move towards openness. Of course, it may be a bit early to declare Verizon Wireless truly open, and it seems a bit odd to dismiss the Skype petition out of hand without any public discussion. While it's probably true that the Skype petition was asking for unnecessary regulations, you would think that at least a discussion could have been held around questions of openness on mobile networks before the petition was totally dismissed.
