Paul Ceglia To Facebook: I Didn't Forge A Contract, You Did!

from the nice-try dept

We just wrote about how, during the discovery process in the lawsuit in which Paul Ceglia claims he only recently discovered a contract giving him more than 50% of Facebook, Facebook found an original contract with identical handwriting on it, that has nothing to do with Facebook, suggesting that Ceglia forged the contract at the center of the dispute.
Ceglia has now responded with the not-particularly-believable claim that he didn't forge the contract, but that Facebook forged that "original" document and placed it on his computer. Even better, he suspects that perhaps Mark Zuckerberg himself was the one who placed it there:
Ceglia’s main argument appears to be that the original “authentic contract” Facebook says it found is really just a Photoshopped image the company planted on his computer. He says he and his lawyers reportedly knew about it for some time and willingly handed it over to Facebook. He declares that his team will prove the image in question “has no authenticating properties whatsoever.”

Ceglia speculates it could have been Zuckerberg himself, or the US law firm Orrick, Herrington & Sutcliffe that may have done the alleged dirty work. He also says Facebook co-founder Eduardo Savrin accused Orrick of “conspiring with Zuckerberg to deprive him of his shares during his case.”
The rest of the article is pretty funny. As we've mentioned in the past, Ceglia has had trouble keeping lawyers, as most of his lawyers have ditched him after becoming more aware of the details of the case. That's generally a huge warning sign that the lawyers don't believe the client. In this article, Ceglia claims that he's looking for a more "collaborative" law firm, and is trying to open source his defense via a wiki (good luck with that). Nothing in the claims that Ceglia makes in this article make him sound any more credible. He's about to lose this lawsuit.

    He's reaching

Ceglia is reaching pretty hard on this one. Planted on his computer? Really? No wonder no lawyer will take his case.

On another note I checked out the zdnet article. A lot of commenters there seem, um.. special. A lot of rage against Facebook.

    Re: He's reaching

I give him a 2/10 for his defense, to earn extra points he really should have suggested it was really planted by aliens from another planet being controlled by the secret mind control waves the government sends out, but which Ceglia's protected from due to his aluminum foil cap!

Sadly that would have sounded about as realistic as his current claims.

    Seriously?

Seriously, look at this clown, and look at the brilliant mind that is Mark Zuckerberg, and ask yourself who actually created Facebook, regardless of who spoke the words together first...

    Dumb Jerk!

Ceglia should just give up right now.
There's no way on earth anyone with even a smidgen of intelligence (and that includes lawyers, judges and juries) would believe such a lame excuse,on par with: "My dog ate the homework."

Funny thing is - if by chance the guy's not lying, it's a perfect plan to get out of a contract... just hack the other party's PC and no lawyer would believe you did it!

I hereby nominate Mr Paul Ceglia for the inaugural TechDirt "Tin Foil Hat Award" of the month

Until the award is finalised, I mean "out_of_the_blue" is also in the running, all contenders should be sent the following Link http://www.ehow.com/how_2049858_make-tinfoil-hat.html making sure to follow the mandatory Tip/Warning of
"It is very important for the shiny side of the aluminum foil to be showing when the hat is complete to make sure it is effective against alien rays or mind control signals."

As for an award, since I am tossing up between this one or this one

Both sides in this dispute have presented documents to the court claiming them to be binding legal contracts. Both sides have also claimed that the other side`s document is a forgery.

I suspect that whichever side loses in this dispute will then face an investigation into possible fraud and forgery charges.
This may explain some of the desperation and `win at all costs` attitudes among the parties.

Ya know, if I was trying to win a lawsuit like this, and they managed to hack my computer like this, I'd have to give up. Even if the contract was bogus, I'd admit defeat.
