DMCA Is Constitutional

from the bad-news dept

A judge has ruled that the Elcomsoft case must continue because the DMCA is constitutional. In a somewhat odd ruling, he said that software code is speech - but not necessarily protected by free speech laws. This means that the court case will go on. I think it's a long shot to hope for a judge to rule against the law. The only way it's going to be changed is when enough lawmakers are convinced that it's a dangerous law that harms technology companies more than helps them.
