MP3.com Sues Law Firm For Malpractice

Now this one is very interesting. It seems that MP3.com is is suing their law firm, Cooley Godward, for having advised them that there was nothing illegal about their My.MP3 service that they launched a few years back - and then had to shut down after a court decided it definitely was illegal. MP3.com is claiming that Cooley should have known better. This is silly for a whole variety of reasons. First of all, I think that Cooley had every reason to believe that what MP3.com was doing was legal (in fact, I still think the court was wrong in their decision). Just because they lost the case it doesn't mean that the company should turn around and sue the lawyers. No one seems to want to accept blame any more. The final decision as to whether or not to launch the service fell to MP3.com and not their law firm.

    While I agree that the suit against the lawyers probably is without merit, I have to enjoy the irony of the tables being turned on them.
