Behind The Scenes At The Microsoft Negotiations

The Wall Street Journal (republished at MSNBC) has a detailed behind-the-scenes article about the Microsoft-DOJ negotiations. Not surprisingly, Microsoft lawyers tried to debate just about every single provision in the agreement, and kept changing the language around to make it less meaningful. The article also describes some of the "back room" negotiating that the various states went through before nine of the eighteen involved in the lawsuits agreed to back the agreement. After reading that article, it's amazing that any settlement came out of it at all. However, it appears that the government was the one that was more willing to settle - which is amusing since they were found to have "won" the case originally.
